Companies are required to apply first for a Department of Labour certificate which authorises them to employ foreign nationals under the South African Corporate Visa rules. The Department of Labour process may prove to be a tedious one as the company will need to prove, among other things, that they are not taking job opportunities away from South African citizens. It is worth noting that the Department of Labour will conduct a compliance inspection of the employer’s premises prior to finalising the Labour Certificate application. Once the application has been submitted to the Department of Labour it will take approximately 30 days for it to be adjudicated.
